Terms of Use

1. About these Terms

These Terms of Use (the "Terms") govern access to and use of the residents' pages of Atherwood.org, including registration at join.atherwood.org and the residents' directory at residents.atherwood.org (together, the "Site"). The Site is a private, non-commercial website for residents of the 64 Eichler homes of the Atherwood tract in Redwood City, California. It is operated by William A. Paxton, a resident ("we," "us," or "our"). It is not operated by a company or by a homeowners association.

By checking the box at registration, or by using the Site, you agree to these Terms and to the Privacy Notice. If you do not agree, do not register or use the Site.

2. Eligibility

You may register only if you are 18 years of age or older and you live in one of the 64 homes. Each adult in a home registers separately. You may hold one account, in your own name, using your own email address.

3. Registration and approval

Registration requires the code delivered to your home and an email address you control. The code is for the people who live in that home; do not give it to anyone else. We review every registration and may approve or decline any registration at our discretion. You may withdraw a pending registration at any time.

4. Your account

You sign in with a code sent to your email address. You are responsible for keeping that email account secure and for activity that takes place under your account. Tell us promptly at hello@atherwood.org if you believe someone else has used your account.

5. Information you provide

You agree that the information you provide is accurate and that you will keep it current, including when you move. You give us permission to store that information and to display the items you choose to show to other approved residents. You decide what is shown, and you can change those choices at any time on "My listing." Any approved adult registered at your home may change the details your household shares.

6. Acceptable use

The directory exists so that neighbors can reach one another for personal, non-commercial purposes. You agree not to:

  • use the Site or anything in it to sell, advertise, solicit, fundraise, or campaign;
  • copy, export, scrape, or compile the directory, or disclose any part of it to anyone who does not live in the 64 homes;
  • harass, threaten, or impersonate any person, or misstate where you live;
  • attempt to gain access to accounts, pages, or data you are not authorized to reach, or interfere with the operation of the Site.

7. Suspension and removal

We may suspend or remove any account at any time, with or without notice. We will remove an account when we learn that its holder is under 18 or no longer lives in one of the 64 homes.

8. Closing your account

You may close your account at any time from "My listing," or by writing to hello@atherwood.org. The Privacy Notice explains what is deleted and when.

9. Third-party services

The Site links to a WhatsApp group for residents. WhatsApp is operated by a third party under its own terms and privacy policy, and we do not control it. Joining the group shows your phone number to its members.

10. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be available, secure, or free of errors, or that information provided by other residents is accurate.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF THE SITE OR FROM THE CONDUCT OF ANY OTHER PERSON WHO USES IT. Our total liability for any claim relating to the Site will not exceed $100.

12. Changes to these Terms

We may update these Terms. When we do, the Site will show you the new version the next time you sign in and ask you to agree again. If you do not agree, you may close your account.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts serving San Mateo County, California.
